When a user submits a photo or a video (both referred to as a “POST”) to the webpage https://www.leonisa.com/ or by agreeing to GLOBAL INTIMATES LLC’s use of a POST in accordance with these terms and conditions, the user accepts that they have read and fully understood them and, in turn, promise to comply with them in their entirety. GLOBAL INTIMATES LLC reserves the right to modify the terms and conditions, therefore the user has the responsibility to read them each time they visit the webpage.
1. Ownership of this site.
The following terms and conditions apply only for this website, which is owned by GLOBAL INTIMATES LLC, a legally constituted company with TAX ID 39-2065424.
2. Users
The user must be at least eighteen (18) years of age in order to grant GLOBAL INTIMATES LLC the rights to use their content on the webpage. The user guarantees that the POSTs that they make are free of any encumbrances that restrict or limit the rights granted to GLOBAL INTIMATES LLC within these terms and conditions. Additionally, the user guarantees that the use of the content by part of GLOBAL INTIMATES LLC in accordance with the rights granted will not violate any copyright, trademark, moral right, or right to privacy or publicity. Nor will it infringe on any industrial or intellectual property right.
The user guarantees that they have the rights, titles, and interests necessary to grant GLOBAL INTIMATES LLC the rights established within these terms and conditions.
GLOBAL INTIMATES LLC reserves the right to delete or remove any image that goes against their content. The company can also delete, withdraw, or suspend any image that includes illegal information without the need for prior notice or notification.
In any case, IP addresses and/or contact information from where the POSTs are uploaded will be saved in order to be made available to authorities if necessary.
4. Disclaimer.
The publication of the POSTs will be the sole and exclusive responsibility of the user.
GLOBAL INTIMATES LLC will not be responsible for the POSTs, nor for any damages caused by their publication on the website, nor for the operation of the website.
5. Personal data.
GLOBAL INTIMATES LLC only collects as personal data the IP addresses from which the POSTs are published or, in specific cases, the information of the authors of each image. The processing of this data will be carried out in accordance with Regulation EU-679/2016.
6. Voluntary assignment of rights
The user guarantees that they voluntarily provide GLOBAL INTIMATES LLC the right to use, access, upload, download, store, install, copy, publish, communicate, display, produce, reproduce, display, and assign the content of the POSTs in accordance with these terms and conditions, and that they will not receive any remuneration or compensation for these rights. The above is valid until the POSTs are discharged.
7. Rights to use content.
The user grants to the name of GLOBAL INTIMATES LLC a non-exclusive license with which they can use, access, upload, download, store, install, copy, publish, communicate, exhibit, produce, reproduce, display, and assign the content. All rights of use in favor of GLOBAL INTIMATES LLC are applicable in any and all media, including print, electronic and/or digital media for advertising, marketing, promotion, and/or editorial purposes.
8. Credit for content.
GLOBAL INTIMATES LLC agrees to including credits to the user whenever their content is used, as long as the creator’s name and/or identity is included.
The user voluntarily waives all moral rights in favor of GLOBAL INTIMATES LLC and under no circumstances shall the failure to include credit by the company, its directors, officers, agents, or employees, constitute a breach of these terms and conditions.
9. Responsibilities.
GLOBAL INTIMATES LLC disclaims liability against losses, claims, demands, adjudications, judgments, actions and proceedings in relation to the POST, against whoever initiated or processed them, and whether or not caused by the negligence of the client, including the actions initiated by third parties alleging infringement or misappropriation of intellectual property rights and content property rights.
10. Duration.
GLOBAL INTIMATES LLC will collect the information from the POSTs for an indefinite amount of time.
11. Revocation.
To express your intent to revoke GLOBAL INTIMATES LLC’s consent to share your content, you must communicate with us via email to infousa@leonisa.com.
12. Applicable law.
These conditions are governed by Regulation EU-679/2016. The user accepts that all matters related to the terms and conditions will be interpreted in accordance with the applicable laws in this matter.
